THE ART OF SETTLEMENT (BOOK ONE)

THE SYNOPSIS

The Ultimate Guide for Trial Lawyers Navigating Catastrophic Case Resolution

The regulatory landscape for personal injury lawyers has never been more complex—or full of landmines. Representing catastrophically injured clients who are disabled exposes trial lawyers to liability, potential government recovery actions, and significant malpractice risks. To protect both your clients and your practice, you need more than your instincts—you need a comprehensive plan.

In the Second Edition of The Art of Settlement, nationally renowned settlement compliance expert Jason Lazarus expands on the indispensable strategies from the first edition and delivers new chapters, tools, and insights to help personal injury practitioners navigate every stage of catastrophic claim resolution compliantly.

What’s New in the Second Edition?

  • A comprehensive lien resolution section featuring several new chapters on resolving liens
  • An in-depth look at lien resolution outsourcing for PI firms and how to avoid liability
  • Updated content on Medicare Secondary Payer Act (MSPA) risks and best practices
  • Chapter summaries and real-world practice tips for faster application in your daily work

You’ll still find foundational guidance on protecting government benefits and ethically navigating financial and planning issues at settlement. But now, with 22 chapters of streamlined, updated content, this second edition goes deeper, offering practical solutions for today’s most pressing settlement challenges.

Whether you’re fighting ERISA liens, negotiating with Medicaid, or worried about Medicare compliance pitfalls that can derail your case, The Art of Settlement remains the essential desk reference for every trial lawyer handling catastrophic personal injury claims.

THE REVIEW

The world of personal injury, litigation, and working with people who suffer from disabilities has become even more complicated in our modern world, especially when it comes to the legal system. In this book, the author does an incredible job of laying out in a very succinct and detailed way the steps those who practice these types of cases or who find themselves involved personally in one of these cases need to take in order to protect themselves from scrutiny and backlash from having taken on these cases to begin with.

The knowledge and insight the book provides really shines a light on aspects of the legal system and the health profession as a whole that so many people not involved in those sectors would never have any idea about. The role insurance, such as Medicare, plays in cases like this, and the role of government as well, is astonishing, especially for anyone who has never had to deal with medical insurance in the United States, let alone cases involving those insurance companies or medical malpractice as a whole. The balance the author finds between the legal education and medical knowledge gained from working with those who have been injured or work with permanent disabilities is perfectly executed in this book.

LITIGATION TO LIFE (BOOK TWO)

THE SYNOPSIS

Jason Lazarus had just set out to meet the Florida dawn and his cycling buddies when a truck veered into the bike lane. He awoke in Orlando’s level one trauma center—jaw wired shut, on a ventilator, every bone in his face broken.

A grueling recovery and litigation process followed—as an expert attorney in the field of settlement planning, Jason had an idea of what came next. However, his own experience as a personal injury victim gave him a newfound appreciation for his work and his clients, who seldom know how to best protect and advocate for themselves when settling their personal injury cases.

Jason wrote Litigation to Life to help injury survivors by demystifying the healthcare, financial, and legal considerations of the settlement process. The book guides injury victims through the settlement challenges following major accidents, empowering them to confidently transition from litigation to settlement and reclaim their lives.

THE REVIEW

This was an expertly written, compelling look at personal injury lawsuits and the experiences those involved have to deal with. The author’s honesty and knowledge, drawn from their experiences as both a lawyer and someone who has suffered a personal injury, made the experiences and insights much more impactful for the reader.

The author’s honesty really allowed the reader to feel a personal connection as they delved into the subject matter. Not only does the author help shed light on the realities surrounding healthcare and personal injury law, but they are able to walk readers in a straightforward, no-nonsense way through the procedures following a personal injury and leading into lawsuits and trials and eventually leading into the settlement process as well.

RATING:: 10/10
